EL PASO COUNTY ONLINE TERMS AND CONDITIONS

Removal. Buyer must remove auction item(s) from the agency premises within ten (10) business days after the time and date of issuance of the Notice of Award. If the Buyer, after making payment for an item, fails to remove the item within the specified time, the agency reserves the right (1) to retain all payments; and (2) to dispose of the item through another auction or otherwise. Successful bidders are responsible for packing, loading, removing and transporting all property awarded to them from the place where the property is located as indicated on the website and in the Notice of Award. The Buyer must make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Under no circumstances will El Paso County assume responsibility for packing, loading or transporting auction item(s). Buyer shall be liable to and reimburse El Paso County for any damage to El Paso County’s property caused by Buyer’s or Buyer Agent’s removal of auction item(s) from the premises. No maintenance may be performed on El Paso County property.

 

WINNING BIDDERS

1. Winner has 5 business days after the date of the Notice of Award of the successful bid to pay. If payment is not received El Paso County can and will mark the buyer in default (forfeiting buyer's bid deposit- if any) and offer the vehicle to the next highest bidder.

2. Pick-ups MUST be scheduled 24 HOURS BEFORE. Pick up hours from 9:00 am-2:30 pm.

3.  Non-operational vehicles must be towed.  No maintenance whatsoever will be allowed on County property other than installation of a new battery.
 
4.  Must have proper vehicle equipment to remove as quickly as possible.  If the equipment is insufficient, you will be turned away and rescheduled for another time.

5.  We do not provide temporary tags, recommend applying for a Vehicle Transit Permit from the Texas DOT.

6. If the listed buyer chooses to send someone else to pick up their purchase, the purchaser must send a signed authorization to epcauctions.gem@epcountytx.gov” from the email on file with Public Surplus stating who may pick it up. A copy of the buyer's photo ID and the Public Surplus Paid Receipt, third party's name, and auction number. The person picking the item up will also be required to have this information with them at time of pick-up. We WILL NOT release anything until we receive this information.

7.  Please do not email an authorization until you contact the office staff.  Also, please confirm that we've received the email.

Your bid is a decision to buy this item. Customers will not be allowed to view an item and then decide whether or not they will buy the vehicle. Ample time is provided to view items before the auction ends. Management reserves the right to block/ban customers who abandon property or refuse to pay for an item.

Payment for an awarded item must be received within five (5) business days after notice of award.


El Paso County may charge sales tax. The tax rate will be calculated at the time of bidding. When sales tax is included, the buyer shall add and include the sales tax amount when making payment.

A Buyers Premium of 10.5% will be added to the final sale price with a $1 minimum charge per auction for payment collections. This premium will be visible during the bidding process and added to the total bid.

All sales are final. Public Surplus will notify buyer of receipt of payment via email.

The successful bidder will be responsible for pick-up of item(s) from the agency's premises. Pick-up must occur within five (5) business days after the payment window closes. The notice of award, payment receipt, and personal identification must be presented at time of pick-up, or the item will not be released.
